The Process is an experience design studio working across learning, culture, and events.
2. Scope and acceptance of these Terms
These Terms and Conditions (“Terms”) govern your use of the Website and, where applicable, your registration for or purchase of events, experiences, programmes, workshops, retreats, learning journeys, gatherings, or other activities offered directly by The Process through the Website or another booking channel.
Client projects and professional engagements are addressed in Section 8 below and are governed by the specific proposal, agreement, statement of work, or other written terms agreed with the relevant client. If there is any conflict between these Terms and specific written terms applicable to an engagement or booking, the specific terms will prevail.
By accessing or using the Website, or by registering for an activity to which these Terms apply, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or complete the relevant registration.
We may update these Terms from time to time. Any changes will take effect when the revised Terms are published on the Website, unless otherwise stated.
3. Purpose and use of the Website
The Website presents our activities, past work, events, experiences, and ways to contact or engage with us. Unless expressly stated otherwise, Website content is provided for general information and does not constitute a binding offer, quotation, or professional advice.
You agree to use the Website lawfully and in a way that does not damage, disable, or impair it or interfere with anyone else’s use. You must not attempt to gain unauthorised access to the Website, its servers, or connected systems, or use automated means to extract, reproduce, or exploit Website content without our permission, except where permitted by applicable law.
4. Intellectual property and Website content
All content created or owned by The Process on the Website, including text, original photographs and videos, graphics, visual identity, logos, and associated marks, is protected by applicable intellectual property laws.
You may access and browse the Website for its intended purpose. Unless expressly authorised by The Process or permitted by applicable law, Website content may not be copied, downloaded, reproduced, printed, distributed, modified, republished, displayed, transmitted, or otherwise used, in whole or in part, without our prior written consent.
Project references and credits. The Website may feature projects, events, programmes, or experiences to which The Process contributed in different capacities. Unless expressly stated otherwise, their inclusion does not imply that The Process was their sole organiser, producer, designer, or service provider. Projects may have been developed or delivered in collaboration with clients, partners, venues, agencies, suppliers, or other contributors. References to such projects are intended to illustrate the nature of our contribution and experience.
Third-party materials. Photographs, videos, logos, project names, and other materials displayed in connection with past work may belong to or depict clients, partners, participants, photographers, or other third parties. Their inclusion on the Website does not imply ownership by The Process. Third-party materials remain subject to the rights of their respective owners and may not be reused without the appropriate permission.
5. Testimonials and project references
Testimonials are the personal opinions of the people quoted, shared with their consent. They describe their own experience and are not a guarantee of any particular result for others.
6. Third-party links and services
The Website may contain links to third-party websites, platforms, or services. We do not control those third parties and are not responsible for their content, availability, terms, or privacy practices.
7. Contact, enquiries, and client engagements
When you contact us through the Website or by email, please provide sufficient and accurate information for us to respond to your enquiry. Submitting an enquiry does not create a contractual relationship. Any potential client engagement will be subject to a separate proposal, agreement, or contract. Personal data submitted through the Website is handled in accordance with our Privacy Policy.
8. Commissioned Projects and Professional Engagements
Client agreements. Client projects, commissions, and professional engagements — including experience design, advisory, facilitation, speaking, and related services — are governed by the specific proposal, agreement, statement of work, or other written terms agreed with the relevant client. These Terms do not replace those arrangements, and the specific terms of the engagement prevail in case of conflict.
Intellectual property. Unless otherwise agreed in writing, The Process retains ownership of its pre-existing and underlying methodologies, frameworks, concepts, tools, know-how, and other intellectual property. Ownership and permitted use of project-specific deliverables will be determined by the terms applicable to the relevant engagement.
Portfolio and reference rights. Unless otherwise agreed in writing, The Process may identify and reference completed projects and professional engagements in its portfolio, Website, credentials, proposals, communications, and business-development materials, including the client or project name, the nature of the engagement, and a description of The Process’s role and contribution. Any such reference will not imply that The Process was the sole organiser, designer, producer, or service provider unless this was the case.
The use of photographs, videos, client logos, project materials, testimonials, or other third-party content remains subject to any applicable confidentiality obligations, intellectual-property rights, image rights, permissions, and specific terms agreed with the client.
Where the existence of a project, the identity of the client, or details of the engagement are confidential, or where the client has requested in writing that the project not be referenced, The Process will respect those restrictions.
Confidentiality, cancellation and changes. Any confidentiality obligations and conditions relating to cancellation, postponement, scope changes, fees, expenses, or termination are governed by the terms applicable to the relevant professional engagement.
9. Events and experiences offered by The Process
From time to time, The Process may organise or offer participation in events, workshops, gatherings, retreats, learning journeys, programmes, or other experiences (“Activities”). The description, dates, location, format, inclusions, exclusions, eligibility requirements, price, and any specific conditions applicable to an Activity will be communicated through the relevant event page, registration form, booking communication, proposal, or other materials provided at the time of registration.
Certain Activities may also be subject to a separate participation charter, code of conduct, travel conditions, or other specific terms. Where such conditions are communicated for an Activity, they form part of the conditions applicable to that participation and prevail over these general Terms on the specific matter they address.
10. Registration and booking
A registration or booking is confirmed only when the conditions communicated for the relevant Activity have been completed, including any required registration information and payment or deposit.
Places may be limited and may be subject to eligibility, capacity, curation, or other participation criteria stated for the relevant Activity. Where an Activity requires confirmation or selection by The Process, submitting a registration form does not by itself guarantee participation.
You are responsible for ensuring that the information provided during registration is accurate and for informing us of relevant changes that may affect your booking.
11. Prices and payment
Prices, payment schedules, deposits, currencies, taxes, and the services or items included in the price will be specified for the relevant Activity. Depending on the Activity, payment may be required in full at registration or may be made according to a stated payment schedule.
Unless otherwise stated, any additional personal expenses, travel, accommodation, meals, insurance, visas, or other services not expressly identified as included remain the participant’s responsibility.
Failure to make a required payment by the applicable deadline may result in the cancellation of the booking, subject to any specific conditions communicated for the Activity.
12. Cancellation by the participant
Cancellation and refund conditions may vary depending on the event or experience and, where specified at the time of booking, those conditions apply. Where no specific cancellation policy is stated, registrations are non-refundable. At our discretion, a registration may be transferred to another participant or credited toward a future experience.
13. Changes or cancellation by The Process
We may make reasonable changes to an Activity where necessary, including changes to the programme, schedule, speakers, facilitators, venues, suppliers, or other elements, while seeking to preserve the overall nature of the experience.
If The Process cancels an Activity, participants will be informed of the options applicable to that Activity, which may include a refund, credit, transfer, or rescheduling, as appropriate and subject to applicable law. Unless expressly stated otherwise or required by law, The Process is not responsible for separate costs incurred by participants in connection with an Activity, such as independently booked travel or accommodation.
14. Participant conduct and participation
Participants are expected to behave respectfully toward other participants, facilitators, partners, staff, venues, and communities involved in an Activity, and to comply with reasonable instructions relating to safety, conduct, and the proper functioning of the experience.
The Process may refuse or discontinue a person’s participation where their conduct is unlawful, unsafe, seriously disruptive, abusive, discriminatory, or materially interferes with the experience of others. Any refund in such circumstances will be determined in accordance with the applicable Activity conditions and applicable law.
Where an Activity has a specific participation charter or code of conduct, participants are also expected to comply with it.
15. Photography, filming, and audiovisual content
Photography, filming, or recording may take place during certain Activities. Where applicable, participants will be informed and any consent required for the use or publication of identifiable images or recordings will be obtained separately, in accordance with applicable law and the conditions communicated for the relevant Activity.
Participants may also be asked to respect restrictions on photographing, filming, or recording other participants, private discussions, performances, materials, or spaces where such restrictions are communicated.
16. Availability and accuracy
We aim to keep the Website and information about our Activities accurate and available, but we do not guarantee uninterrupted access or that all content will always be complete, current, or free of errors. We may update, suspend, or remove Website content or functionality from time to time.
Obvious errors in published information, including pricing or programme information, may be corrected. Where such an error materially affects an existing booking, we will contact the affected participant and address it in accordance with applicable law and the relevant booking conditions.
17. Limitation of liability
To the fullest extent permitted by applicable law, The Process shall not be liable for losses arising solely from reliance on general Website content, temporary unavailability of the Website, or the use of third-party websites linked from it, except where liability cannot lawfully be excluded or limited.
For Activities, any liability of The Process is subject to the specific conditions applicable to the relevant Activity and to mandatory provisions of applicable law. Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
18. Personal data
Personal data collected through the Website, enquiries, registrations, or Activities is handled in accordance with our Privacy Policy and, where relevant, any additional information or consent provided in connection with a specific Activity.
19. Governing law and jurisdiction
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute relating to the Website, an Activity, or these Terms shall be subject to the jurisdiction of the competent Moroccan courts, subject to any mandatory rules of applicable law.
